Gift Card

1 – Description and validity of the Gift Card

The Gift Card consists of a declining balance credit, equal to its nominal amount, available in different denominations and is issued virtually by AryA Italian Jewels, hereinafter referred to as AryA. Each Gift Card has an associated unique CODE.

It can be purchased exclusively on our webstore www.aryaitalianjewels.com, hereinafter referred to as the Site, to be used by the Purchaser, hereinafter also referred to as the Customer, or given to another person, hereinafter referred to as the Recipient, to purchase any product on the Site, with the exception of further Gift Cards, even multiple times, until its value is exhausted.

It will be sent via e-mail or shipped to the Purchaser or the Recipient once the purchase is completed and the relative payment has been verified.

The Customer can decide to have the e-mail with the Gift Card sent directly by AryA to the Recipient by entering the name, their e-mail, and the sending date directly at the time of the Card purchase, or choose to receive it at their e-mail address provided during the purchase/registration phase. It may be sent to third parties by the Customer at any time, and its value will be that of the credit existing at the time of sending.

The Gift Card is virtual only and is valid for 12 months from the date of the receipt email containing its CODE.
The amount paid for the purchase of the Gift Card will be transferred to the seller as a non-interest-bearing deposit.
It cannot be converted into cash, nor can it be credited to a credit card or a bank account.
Upon expiration of the Gift Card, any remaining and unused balance will not be refunded.

The purchase of the Gift Card is not subject to the application of VAT pursuant to art. 2, paragraph 3, letter a), D.P.R. 633/1972.

2 – Procedures for purchasing the Gift Card

By following the procedure indicated on our Site, the Customer can choose one or more Gift Cards.
Before proceeding with the purchase, the Customer will view the summary of their order, where they will verify their data, if registered, or enter their data for the invoice/order heading, and choose the payment method for the order from those available on the Site.

For the purchase of the Gift Card, Cash on Delivery is not permitted.
Each Gift Card must be purchased separately from items and products in other categories.

By clicking the “ORDER NOW” button, the Customer declares to have read and verified that the order is correct, and to expressly approve the General Terms and Conditions of Sale of our Site, of which these Conditions are an integral part, committing to complete the procedure with the payment of the order in the chosen method.
Once the purchase has been made, AryA must verify that the payment has been credited before proceeding with sending the Gift Card acceptance e-mail.
If the payment is made by credit card or Paypal, the purchase amount will be charged and verified exclusively upon the successful conclusion of the payment phase immediately following the sending of the Customer’s order confirmation.
In case of deferred payment by bank transfer or top-up of the corporate Postepay card, the timing is different. Verification of the Postepay top-up is immediately following the Customer’s communication, while verification of the bank transfer credit takes approximately 2 working days from the payment date communicated by the Customer.

At the end of the purchase procedure on our Site, the Customer will receive a confirmation e-mail of their order, containing the order number, details of the Gift Card(s) purchased, the total paid or to be paid in case of deferred payment (bank transfer or Postepay top-up), and the Terms and Conditions of Sale.
The Customer is required to verify the accuracy of the order and promptly communicate any anomaly or variation to the Seller before the Gift Card acceptance email is sent.

During the purchase phase, the Customer must enter the following data for each card purchased:
Recipient’s name, recipient’s e-mail, message text, Gift Card sending date.
In the event that no date is indicated for sending, the Gift Card will be sent via e-mail to the recipient as soon as the checks regarding the successful outcome of the payment for the Card itself have been carried out.

The Recipient’s data will be processed exclusively to allow AryA to send the Gift Card via e-mail and to fulfill the resulting services and obligations by our Company.
Such data (recipient’s name and email address) will be kept only until the expiry of the deadline for the exercise of the right of withdrawal by the Customer.
Once this deadline has expired, the Recipient’s data processed for the purposes indicated here will be deleted.

The Customer is warned and declares to be aware that the incorrect indication of the Recipient’s e-mail address to which they wish to send the Gift Card, indicated during its purchase process, will make it impossible for the recipient to receive and use the Gift Card itself, without any responsibility being attributed to AryA.

The Recipient will receive an e-mail containing the virtual Gift Card, along with the sender’s name and any message. The Gift Card will show its unique CODE, with which they will be entitled to use it until its value is exhausted, based on these conditions, within its expiration date.
The Purchaser may decide whether to exercise the right of withdrawal within 14 days from the date of purchase.

It is expressly understood that for the Gift Card purchased, for oneself or to give as a gift to a third party, the 12 (twelve) month period of validity will run from the receipt by the Customer or the Recipient of the e-mail with the purchased Gift Card, regardless of the date on which it is used.

3 – How to use the Gift Card

The Gift Card is sent, at the Purchaser’s choice, by e-mail or on paper.
Once the e-mail with the Gift Card has been received, it will be considered activated and will have an expiration of 12 months from the day of receipt.

Immediately after activation, the Gift Card can be used right away to purchase any product on the Site, with the exception of a new Gift Card.
The Gift Card also covers shipping costs, where applicable, and any purchases of ancillary services.

To use the Gift Card, it is necessary to enter the CODE in the space reserved for the Discount Voucher, in the Cart or on the order summary page.
In the event that the total amount of the order, including shipping costs, is higher than the credit available in the Gift Card, the remaining amount must be paid by the Customer, or by the beneficiary of the Card, using one of the payment methods available on the Site, in order to complete the order.
In the event that the total amount of the order is lower than the credit available on the Gift Card, this will be used to cover the order, with a residual credit to be used for subsequent purchases.

The Gift Card can also be used for multiple purchases, until the credited amount is exhausted, and in any case within its period of validity. Upon expiration, the remaining credit will under no circumstances be refunded, nor can it be used for new purchases.
For each order, only one Gift Card can be used.
In case of using a Discount Coupon, the Customer will not be able to use the Gift Card for the payment of the order.

The Customer who owns the Gift Card, by accepting these Conditions, declares to be aware that knowledge of the Gift Card CODE allows its use by anyone for purchases on our Site.
The CODE is personal and must therefore be kept and guarded with care by the Customer, or by the Recipient in the case of a gift.
No responsibility can be attributed to AryA for the use by third parties, known or unknown to the purchaser, of the Gift Card to pay for purchases made on our Site.

4 – Right of withdrawal

The purchasing Customer can exercise the right of withdrawal from the purchase contract of a Gift Card within 14 days from receipt of the activation e-mail.
The right of withdrawal can be used if the Gift Card has never been used, even partially, for purchases on our Site.

To exercise this right, the Customer must send an e-mail to [email protected], expressing their will to withdraw and indicating the order number of the Gift Card.
AryA will proceed to verify the integrity of the Gift Card credit and will send a confirmation e-mail of the withdrawal and the deactivation of the relative CODE.
No later than 14 days from the withdrawal request, Arya will refund the amount paid for the Gift Card using the same payment method used to pay for the order subject to withdrawal, reversing the order charge transaction.
Where this is not possible, AryA will proceed to make a bank transfer of the order amount. In this case, the Customer is required to promptly provide the bank details necessary for the transfer.
In the event that the Customer requests a refund on a different means of payment, any additional costs deriving from the refund through said different means of payment will be at their total expense.

In case of withdrawal on the purchase of a Gift Card donated to third parties, the Recipient will be notified by e-mail of the deactivation of the Gift Card and the relative CODE due to the withdrawal by the purchasing Customer.

If the right of withdrawal is exercised on the purchase of products paid for using, totally or partially, a Gift Card, AryA will restore the credit of the Gift Card used, re-crediting the portion paid via Gift Card. For the difference, the methods reported above will be used.
